DayStalkers provides websites, research databases, mapping tools, documentation, subscription services, the DayStalkers Bigfoot Atlas, Project Cryptanthropus, and related content and technology collectively referred to as the “Services.”
By accessing, registering for, purchasing, or using any part of the Services, you agree to these Terms of Service. If you do not agree to these Terms, do not use the Services.
The Services are provided for research, documentation, historical preservation, investigative analysis, geographic visualization, education, and informational purposes.
Historical records, community submissions, and analytical outputs represent reported information and research interpretations. They do not constitute verified biological evidence or confirmation that any reported event occurred.
The Services are not intended to provide legal, medical, safety, wildlife-management, emergency, navigation, or professional field guidance.
The Services may collect, organize, analyze, and display information from sources including public-domain archives, historical newspapers, government materials, research collections, independent researchers, members, and user-submitted reports.
Historical and user-provided information may contain inaccuracies, approximate locations, incomplete context, transcription errors, misidentifications, or unsupported claims. DayStalkers does not guarantee the accuracy, completeness, reliability, or timeliness of any report, dataset, map, statistic, or analytical result.
DayStalkers does not claim ownership of public-domain materials and does not claim affiliation with private reporting organizations, researchers, publishers, government agencies, or other sources unless explicitly stated.
By submitting a report, photograph, recording, document, location, research note, or other material, you represent that:
Submissions may undergo automated processing, manual review, or both. DayStalkers may request clarification, standardize information, classify or reclassify reports, generalize locations, correct formatting, delay publication, decline publication, or remove material when necessary to protect privacy, safety, research quality, or database integrity.
Submitting material does not guarantee publication, inclusion in the Atlas, or continued availability.
Material collected through authorized Atlas applications, including future offline field-data collection tools, is subject to these same Terms.
You retain ownership of original material that you submit.
By submitting material, you grant DayStalkers a non-exclusive, worldwide, royalty-free license to receive, store, archive, preserve, reproduce, organize, standardize, classify, analyze, display, publish, distribute, and incorporate the material into the Services.
This license also permits appropriate use within Project Cryptanthropus research resources, maps, statistical summaries, newsletters, educational material, research publications, analytical models, and future Atlas features.
Whenever practical, original contributors and sources may be acknowledged. DayStalkers cannot guarantee attribution in every database display, map, summary, or analytical output.
You agree not to:
Certain Services may require an account, membership, subscription, invitation, or specific authorization.
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.
DayStalkers may restrict, suspend, or terminate access for violations of these Terms, fraudulent activity, payment failures, attempts to manipulate Atlas data, security threats, or other misuse of the Services.
Access may be permanently terminated without refund when permitted by law.
Certain features may require payment or an active subscription. Prices, billing periods, included features, and availability may change.
Paid Services are also governed by the Refund and Digital Services Policy available at Refund Policy.
Unless otherwise stated or required by applicable law, payments for digital access and subscription periods are non-refundable.
Information displayed through the Services may relate to outdoor research, remote areas, travel, public lands, wildlife, roads, trails, waterways, abandoned locations, or private property.
Any field investigation, travel, observation, or outdoor activity is undertaken entirely at your own risk.
You are responsible for evaluating weather, terrain, road conditions, wildlife, personal health, emergency access, land ownership, and other hazards before entering any location.
You are also responsible for complying with trespass laws, public-land regulations, wildlife laws, local ordinances, closures, permit requirements, and all other applicable rules.
The Services do not authorize access to private property, restricted land, closed roads, protected areas, or unsafe locations.
Atlas features may include clusters, hotspots, state and county rankings, Probability Heat, Habitat Heat, movement corridors, proximity results, Timeline Explorer visualizations, confidence indicators, and other analytical outputs.
These outputs are mathematical, geographic, statistical, environmental, or interpretive visualizations derived from available data.
They do not represent confirmed creature presence, verified movement, biological identification, wildlife tracking, scientific proof, or guaranteed predictions of future activity.
Hotspot markers may represent calculated cluster centers rather than individual sighting locations. Analytical markers may therefore appear over developed areas, water, roads, or other locations positioned near the center of the qualifying reports.
Unless otherwise stated, the Services and their original content, software, processors, source code, databases, documentation, design, graphics, branding, analytical systems, classification methods, and organizational structure are owned by or licensed to DayStalkers.
Nothing in these Terms transfers ownership of DayStalkers intellectual property to any user.
Public-domain source material remains public domain. Third-party material remains subject to the rights of its respective owner.
The Services may rely upon or link to third-party providers, payment processors, hosting platforms, mapping services, databases, archives, authentication systems, or external websites.
DayStalkers does not control and is not responsible for the availability, security, content, accuracy, privacy practices, or policies of third-party services.
Your use of third-party services may be subject to separate terms and policies established by those providers.
The Services may be updated, modified, restricted, suspended, or discontinued at any time.
Access to any particular feature, dataset, report, document, subscription benefit, or analytical tool is not guaranteed to be continuous, permanent, or error-free.
Reports, statistics, rankings, locations, classifications, and analytical outputs may change as new information is added, duplicates are removed, sources are corrected, submissions are moderated, and processing methods are refined.
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied.
To the fullest extent permitted by law, DayStalkers disclaims warranties including accuracy, reliability, availability, merchantability, non-infringement, security, and fitness for a particular purpose.
To the maximum extent permitted by law, DayStalkers and its owners, operators, contractors, contributors, and service providers will not be liable for direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to use of, inability to use, or reliance upon the Services.
This includes damages related to loss of data, loss of access, field activity, personal injury, property damage, legal consequences, business interruption, inaccurate information, third-party services, or unauthorized account activity.
You agree to defend, indemnify, and hold harmless DayStalkers and its owners, operators, contractors, contributors, and service providers from claims, liabilities, losses, damages, expenses, and reasonable legal fees arising from:
DayStalkers is not responsible for delay, interruption, data loss, or failure caused by events beyond its reasonable control, including utility failures, Internet outages, hosting failures, third-party service disruptions, cyberattacks, natural disasters, severe weather, government action, labor disruption, or equipment failure.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles.
Any legal action relating to these Terms or the Services must be brought in a court of competent jurisdiction located in Michigan, unless applicable law requires otherwise.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect.
Failure by DayStalkers to enforce any provision of these Terms does not waive the right to enforce that provision later.
These Terms, together with the Privacy Policy, Community Guidelines, Refund Policy, and other policies referenced within the Services, constitute the entire agreement between you and DayStalkers concerning use of the Services.
DayStalkers may revise these Terms as the Services, laws, technology, or business practices evolve.
Updated Terms will be posted with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
