DayStalkers provides websites, research databases, mapping tools, documentation, subscription services, the DayStalkers Bigfoot Atlas, Project Cryptanthropus, and related content, software, technology, and research resources collectively referred to as the “Services.”
By accessing, registering for, purchasing, subscribing to, or using any part of the Services, you agree to these Terms of Service.
If you do not agree to these Terms, do not access or use the Services.
The Services are provided for research, documentation, historical preservation, investigative analysis, geographic visualization, education, and informational purposes.
Historical records, community submissions, and analytical outputs represent reported information and research interpretations. They do not constitute verified biological evidence or confirmation that any reported event occurred.
The Services are not intended to provide legal, medical, safety, wildlife-management, emergency, navigation, or other professional guidance.
The Services may collect, organize, analyze, and display information from sources including public-domain archives, historical newspapers, government materials, environmental datasets, research collections, independent researchers, members, and user-submitted reports.
Historical and user-provided information may contain inaccuracies, approximate locations, incomplete context, transcription errors, misidentifications, unsupported claims, or conflicting information.
DayStalkers does not guarantee the accuracy, completeness, reliability, availability, or timeliness of any report, dataset, map, statistic, classification, location, or analytical result.
DayStalkers does not claim ownership of public-domain materials and does not claim affiliation with private reporting organizations, publishers, researchers, government agencies, or other sources unless explicitly stated.
By submitting a report, photograph, recording, document, coordinate, location, research note, map, or other material, you represent and warrant that:
Submissions may undergo automated processing, manual review, or both.
DayStalkers may request clarification, standardize information, classify or reclassify reports, correct formatting, generalize locations, anonymize identifying details, delay publication, decline publication, or remove material when necessary to protect privacy, safety, research quality, legal compliance, system reliability, or database integrity.
Submitting material does not guarantee publication, inclusion in the Atlas, acknowledgment, compensation, or continued availability.
Material collected through authorized Atlas applications, including future offline field-data collection and synchronization tools, is subject to these same Terms.
You retain ownership of original material that you submit.
By submitting material, you grant DayStalkers a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to receive, store, archive, preserve, reproduce, organize, standardize, classify, geocode, analyze, display, publish, distribute, summarize, adapt for formatting, and incorporate the material into the Services.
This license permits appropriate use within the Bigfoot Atlas, Project Cryptanthropus research resources, maps, databases, statistical summaries, newsletters, educational material, books, articles, research publications, analytical models, and future DayStalkers features.
This license continues for as long as the material remains part of DayStalkers research, archival, analytical, legal, or operational records, subject to applicable law.
Whenever practical, original contributors and sources may be acknowledged. DayStalkers cannot guarantee attribution in every database display, map, summary, publication, or analytical output.
Unless otherwise stated, the Services and their original content, software, source code, processors, databases, documentation, interfaces, graphics, designs, branding, analytical systems, classification methods, geographic models, visual outputs, and organizational structure are owned by or licensed to DayStalkers and Daniel Reidmiller.
The DayStalkers Research Network, the Bigfoot Atlas, and Project Cryptanthropus include proprietary branding, compiled datasets, analytical systems, investigative mapping tools, interfaces, clustering methods, visualizations, and platform architecture.
The organization, selection, arrangement, compilation, classification, coordination, geographic presentation, and analytical presentation of reports, coordinates, metadata, source information, statistical outputs, and associated datasets constitute a proprietary research database and investigative analysis system protected under applicable law.
Nothing in these Terms transfers ownership of DayStalkers intellectual property to any user, member, subscriber, contributor, researcher, or third party.
Public-domain source material remains public domain. Third-party material remains subject to the rights of its respective owner.
Except where expressly permitted in writing, no portion of the Services may be reproduced, redistributed, scraped, copied, downloaded in bulk, mirrored, harvested, stored, transmitted, republished, resold, licensed, or commercially reused.
Automated scraping, bulk extraction, dataset harvesting, automated querying, systematic downloading, reverse engineering, database reconstruction, or derivative commercial use of the Services is strictly prohibited.
You may not use Atlas reports, coordinates, analytical outputs, documentation, rankings, clusters, hotspots, heat maps, movement corridors, probability models, habitat models, or database structure to create or support a competing product, commercial database, paid publication, subscription service, software platform, or analytical system without prior written permission.
Limited quotations or references for commentary, criticism, scholarship, or news reporting must include appropriate attribution and may not reproduce substantial portions of the proprietary database or Services.
You agree not to:
Certain Services may require an account, paid membership, subscription, invitation, or administrative authorization.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You agree to provide accurate account information and to notify DayStalkers if you believe your account has been accessed without authorization.
DayStalkers may restrict, suspend, or terminate access for violations of these Terms, fraudulent activity, payment failures, attempts to manipulate Atlas data, abusive conduct, security threats, or other misuse of the Services.
Access may be permanently terminated without refund where permitted by law.
Certain features may require payment or an active subscription.
Prices, billing periods, included features, access levels, and availability may change.
Paid Services are also governed by the Refund and Digital Services Policy available at Refund and Digital Services Policy.
Unless otherwise stated or required by applicable law, payments for digital access, memberships, subscriptions, and billing periods are non-refundable.
Subscription Services may renew automatically at the end of each billing period unless cancelled before the applicable renewal date.
You are responsible for managing and cancelling your subscription if you do not wish to continue service.
Cancellation prevents future renewal charges but does not retroactively refund completed charges or subscription periods that have already begun.
Unless otherwise stated, access may continue through the end of the current paid billing period.
Information displayed through the Services may relate to outdoor research, remote areas, travel, public lands, wildlife, roads, trails, waterways, abandoned locations, or private property.
Any field investigation, travel, observation, or outdoor activity is undertaken entirely at your own risk.
You are responsible for evaluating weather, terrain, road conditions, wildlife, personal health, emergency access, land ownership, and other hazards before entering any location.
You are responsible for complying with trespass laws, public-land regulations, wildlife laws, local ordinances, closures, permit requirements, and all other applicable laws and rules.
The Services do not authorize access to private property, restricted land, closed roads, protected areas, archaeological sites, environmentally sensitive locations, or unsafe areas.
Atlas features may include reports, clusters, hotspots, state and county rankings, Probability Heat, Habitat Heat, movement corridors, proximity results, Timeline Explorer visualizations, confidence indicators, and other analytical outputs.
These outputs are mathematical, geographic, statistical, environmental, computational, or interpretive visualizations derived from available information.
They do not represent confirmed creature presence, verified movement, biological identification, wildlife tracking, scientific proof, or guaranteed predictions of future activity.
Hotspot markers may represent calculated cluster centers rather than individual sighting locations.
An analytical marker may therefore appear over a developed area, road, waterway, private property, or other location positioned near the geographic center of the qualifying reports.
Users are responsible for evaluating Atlas outputs independently and should not treat analytical results as factual determinations or instructions to enter a particular area.
The Services may rely upon or link to third-party providers, payment processors, hosting platforms, database services, mapping services, archives, authentication systems, email providers, analytics services, or external websites.
DayStalkers does not control and is not responsible for the availability, security, content, accuracy, privacy practices, policies, failures, or actions of third-party services.
Your use of third-party services may be subject to separate terms, privacy policies, and requirements established by those providers.
The Services may be updated, modified, reorganized, restricted, suspended, replaced, or discontinued at any time.
Access to any particular feature, dataset, report, document, subscription benefit, processor, visualization, or analytical tool is not guaranteed to be continuous, permanent, secure, or error-free.
Reports, statistics, rankings, coordinates, classifications, and analytical outputs may change as new information is added, duplicate records are removed, sources are corrected, submissions are moderated, and processing methods are refined.
The addition, modification, reorganization, or removal of features as part of normal platform development does not automatically create a right to a refund.
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied.
To the fullest extent permitted by law, DayStalkers disclaims warranties including accuracy, completeness, reliability, availability, merchantability, non-infringement, security, and fitness for a particular purpose.
DayStalkers does not warrant that the Services will operate without interruption, error, data loss, unauthorized access, security incidents, or third-party service failures.
To the maximum extent permitted by law, DayStalkers and its owners, operators, contractors, contributors, licensors, and service providers will not be liable for direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to use of, inability to use, or reliance upon the Services.
This limitation includes damages related to loss of data, loss of access, subscription interruption, field activity, personal injury, property damage, legal consequences, inaccurate information, business interruption, third-party services, security incidents, or unauthorized account activity.
Where applicable law does not allow the exclusion or limitation of certain damages, liability will be limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless DayStalkers and its owners, operators, contractors, contributors, licensors, and service providers from claims, liabilities, losses, damages, expenses, and reasonable legal fees arising from:
DayStalkers is not responsible for delay, interruption, data loss, degraded performance, or failure caused by events beyond its reasonable control.
Such events may include utility failures, Internet outages, hosting failures, database failures, payment-provider disruptions, mapping-provider outages, cyberattacks, natural disasters, severe weather, government action, labor disruption, equipment failure, or failures of third-party infrastructure.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles.
Any legal action relating to these Terms or the Services must be brought in a court of competent jurisdiction located in Michigan unless applicable law requires otherwise.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect.
Failure by DayStalkers to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision later.
You may not assign or transfer your rights or obligations under these Terms without prior written permission from DayStalkers.
DayStalkers may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale, transfer of assets, or continuation of the Services under another legal entity.
These Terms, together with the Privacy Policy, Community Guidelines, Refund and Digital Services Policy, and other policies expressly incorporated by reference, constitute the entire agreement between you and DayStalkers concerning use of the Services.
DayStalkers may revise these Terms as the Services, laws, technology, research practices, or business operations evolve.
Updated Terms will be posted with a revised effective date.
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
